Terms of Service
Written plainly. Meant to be kept.
These terms are an agreement between you and American Marksman Company Inc., doing business as American Precision Rifleworks (“APR,” “we,” “us”), of Volusia County, Florida. They apply to americanprecisionrifleworks.com, to our online store and checkout, to custom rifle builds, and to gunsmithing services. By using the site or placing an order you accept them. The American Marksman Ballistics app is governed by its own terms at /app/terms/. OurPrivacy Policy, Shipping Policy,Returns Policy, and FFL Transfer Policyare part of these terms.
1. Who may use the site and buy from us
- You must be at least 18 years old to use this site and to purchase rifles, rifle ammunition, and accessories, and at least 21 to purchase handgun ammunition.
- You must be legally eligible under federal, state, and local law to possess any firearm or ammunition you order, and you must not be buying on behalf of someone who is not.
- We may refuse, cancel, or limit any order, and decline any transfer, when we believe completing it would be unlawful, unsafe, or contrary to these terms. Where we cancel, we refund what you paid for the cancelled items.
2. Orders, prices, and payment
- Listing an item is an invitation to order; an order is accepted when we confirm it and the item ships or the work begins. We may correct pricing or description errors and offer you the choice to proceed at the corrected price or cancel for a full refund.
- Prices are in U.S. dollars and exclude shipping and applicable sales tax, which are shown at checkout.
- Payments are processed by our payment processor. We do not store full card numbers. Orders may be held for verification.
- Products are subject to availability. If something you ordered becomes unavailable we will tell you promptly and refund it.
3. Firearms
- Every firearm ships only to a Federal Firearms Licensee (FFL) you choose in your state, never to your door. You complete the transfer in person with that dealer, including the federal background check and Form 4473. The receiving dealer may charge a transfer fee, which is between you and the dealer.
- You are responsible for confirming that the firearm is legal to own where you live and that your dealer will accept it. We will do our best to flag known restrictions, but the final responsibility is yours.
- If a transfer cannot be completed because you are not eligible or your dealer declines, the firearm returns to us and we refund the purchase price less the shipping costs actually incurred and any fees charged by third parties.
- We keep the acquisition and disposition records federal law requires of licensed dealers.
4. Ammunition and restricted items
- Ammunition ships by ground only, with an adult signature required on delivery, and only to states and localities where we can lawfully ship it. We do not ship magazines, ammunition, or other items to jurisdictions that prohibit them, and we may cancel such orders.
- By ordering ammunition you confirm you meet the federal age requirement for the type ordered and are not prohibited from possessing it.
5. Custom rifle builds
- Consultation and quote. Build inquiries are free and carry no obligation. Before you commit, we spec the rifle and quote it in writing. The written quote is the price; there are no surprise upcharges after you accept it, unless you ask for changes.
- Deposit and balance. Once you accept a quote we ask for a good-faith deposit, typically 10–15% of the quoted price, to order long-lead components such as barrels and stocks. The balance is due before the rifle ships or is picked up. For builds with unusually long component lead times we may agree a different schedule in writing.
- Lead time. A typical build takes 10–16 weeks. Lead times are honest estimates dominated by component supply, not guarantees; we tell you the expected window when we quote and update you at each milestone.
- Changes. Changes you request after components are ordered may change the price and the lead time. We will tell you before proceeding.
- Cancellation. You may cancel before components are ordered for a full refund of the deposit. After components are ordered, the deposit is applied to those components and is refundable only to the extent we can return or resell them.
- Customer-supplied components. We will often build with actions, stocks, and triggers you already own. We bill labor at our standard rates and stand behind our workmanship, but we do not warrant third-party components themselves.
- Delivery. Completed rifles ship to your FFL under Section 3, or are picked up in person by appointment with the required transfer paperwork.
6. The accuracy guarantee
Every rifle we build is guaranteed in writing to shoot 0.5 MOA or better at 100 yards, meaning a three-shot group of one half inch or less from a stable rest, with match-grade ammunition suited to the barrel. We ship a test target with the rifle showing the group we achieved. If your rifle, as delivered and unmodified, cannot meet that standard with appropriate match ammunition, tell us within 60 days of delivery and we will diagnose it and make it right, including re-barreling at our expense if that is what it takes. The guarantee does not cover customer-supplied components, handloads or bulk ammunition, damage, modifications, or wear, and it is a guarantee of the rifle’s mechanical accuracy, not of any shooter’s results.
7. Gunsmithing services
- We provide a written estimate before starting work and will not exceed it without your approval. Diagnostic time may be charged if you decline the work.
- We are not responsible for pre-existing damage, defects, or unsafe conditions we did not create, though we will tell you when we find them and may decline unsafe work.
- Firearms left with us must be transferred in and out according to federal law. Items unclaimed after 90 days of written notice may be treated as abandoned to the extent Florida law allows, after further notice.
- We stand behind our workmanship for the life of the work we performed. Parts carry their manufacturers’ warranties.
8. Shipping, returns, and risk of loss
Shipping and returns are governed by our Shipping Policy andReturns Policy. Federal and state law limit the return of firearms and ammunition; where a return is not lawful we will work with you on a warranty or repair path instead. Risk of loss passes to you when the carrier delivers to you or to your FFL.
9. Safety and your responsibility
Firearms are inherently dangerous. You are responsible for safe handling, storage, and use, for obtaining appropriate training, for using ammunition and accessories that are correct for your rifle, and for complying with every law that applies to you. Nothing on this site is legal advice or a substitute for training.
10. Warranties and disclaimers
Except for the accuracy guarantee in Section 6 and our workmanship commitments in Sections 5 and 7, products are sold with the manufacturer’s warranty only, and the site and its content are provided “as is.” To the extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose. Some states do not allow these limitations, in which case they apply only as far as the law permits.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages arising from the site, a product, or a service, and our total liability for any claim is limited to the amount you paid us for the product or service that gave rise to it. This does not limit liability that cannot be limited by law.
12. Indemnification
You agree to defend and hold us harmless from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your unlawful, negligent, or unsafe use of a product, your breach of these terms, or your violation of any law.
13. Intellectual property
American Precision Rifleworks, American Marksman, the American Marksman brandmark, and the content, photographs, and design of this site belong to American Marksman Company Inc. or its licensors. You may not copy, reproduce, or use them commercially without our written permission. Manufacturer names and marks belong to their owners and are used to identify genuine products.
14. American Marksman and training
Information about the American Marksman program and training on this site is informational. When training is offered, it will have its own registration terms, which will be provided before you sign up. Nothing on the site creates a certification, rank, or credential.
15. Governing law and disputes
These terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. Before either of us brings a claim, we agree to try to resolve it informally by email or phone for at least 30 days. Any claim that cannot be resolved will be brought in the state or federal courts serving Volusia County, Florida, and you consent to their jurisdiction.
16. Changes and the rest
We may update these terms; the effective date at the top tells you when. Changes apply to orders placed after they take effect. If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with the policies linked above and your written quote, are the entire agreement between us for a purchase or build.
