American Marksman Ballistics is a training aid that estimates a firing solution from what you and your devices tell it. These terms say what that means, what you are responsible for, and where the limits of a beta lie.

1. Who these terms are between

These terms are an agreement between you and American Marksman Company Inc. of Volusia County, Florida, USA (“we”, “us”). They cover theAmerican Marksman Ballistics app on iPhone and Android, its web test build, and any test build we invite you to install. By installing or using the app you accept them. If you do not accept them, do not use the app.

2. What the app is, and is not

The app is a field ballistic calculator. It computes an estimatedfiring solution — how far to turn a scope’s turrets, or how much to hold — from the rifle, ammunition, scope, zero, distance, and conditions that you enter or that your connected devices report.

It is a training aid. It has not completed live-fire validation or independent technical review. Its output is an estimate that can be wrong, and it will be wrong when an input is wrong: a mistaken zero, a scope whose real click value differs from the box, a box velocity that is not your rifle’s, a stale weather reading. The app labels its inputs so you can check them; checking them is your job.

The app is not a substitute for verified data on your own rifle, for safe firearm handling, for your own judgement, or for the rules of the range you are on. It does not make you eligible to own, carry, or use a firearm, and it does not tell you whether a shot is lawful, ethical, or safe.

3. Safety — your responsibilities

You are solely responsible for the safe handling and use of any firearm, and for every shot you fire.
Never fire a shot you are not certain is safe. Identify your target and what lies beyond it. A firing solution is not a clearance to shoot.
Confirm the app’s output at known distances before relying on it, and again whenever you change a rifle, a load, a scope, or a zero.
Verify what you enter. Muzzle speed, zero distance, sight height, and click value move the answer more than anything the app can measure for you.
Obey every applicable law, regulation, and range rule. Where they conflict with anything the app shows, they win.
The app is intended for adults. Using it does not establish your eligibility to possess or use a firearm under the law that applies to you.

4. Beta software

The app is in an invitation-only field test. It may change, break, lose a feature, or be withdrawn without notice, and we may end the test or your part in it at any time. Keep your own records: Download my dataexports everything the app holds, and we recommend using it before every update. Test builds installed through TestFlight or Google Play testing tracks are also subject to Apple’s and Google’s terms for those programs.

5. Your data

The data you enter stays on your device and belongs to you. Ourprivacy policy describes the two requests the app makes over the network and everything else it touches. You are responsible for any file you export and for whom you share it with.

6. Devices and third-party services

Connecting a rangefinder, chronograph, weather meter, or watch is your choice and at your risk. The app reads from devices; it does not change their settings. Device makers are not affiliated with us and have not endorsed the app; their names are used only to describe compatibility. Weather observations come from the U.S. National Weather Service and the projectile catalog from our catalog server, each as is and subject to interruption. A stale or missing reading is shown as such; the app does not fill the gap with a guess.

7. Licence and intellectual property

We grant you a personal, revocable, non-transferable licence to install and use the app for your own shooting. The app, its solver, its content, and the American Marksman name and marks are ours. You may not copy, sell, rent, sublicense, or redistribute the app, or reverse engineer it except to the extent the law allows regardless of this clause. Feedback you send us may be used to improve the app without obligation to you.

8. No warranty

The app is provided as is and as available, without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app’s output is correct, that the app will be uninterrupted or error-free, or that any device will connect or stay connected.

9. Limitation of liability

To the fullest extent permitted by law, American Marksman Company Inc., its officers, and its contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, property damage, injury, or death, arising out of or related to your use of or inability to use the app, including any reliance on its output, however caused and under any theory of liability. To the extent liability cannot be excluded, it is limited to the amount you paid for the app, which is nothing. Some jurisdictions do not allow some of these exclusions, so some may not apply to you.

10. Indemnity

You agree to hold us harmless from claims, losses, and costs arising from your use of a firearm, your breach of these terms, or your violation of any law or range rule while using the app.

11. Ending the agreement

You may stop using the app at any time by deleting it. We may suspend or end your access to the test at any time. Sections 3 and 7 through 12 survive.

12. Governing law

These terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Florida.

13. Changes

We may update these terms. The effective date at the top changes when we do, and material changes are noted in the release notes of the version that makes them. Continuing to use the app after a change means you accept it.
